BrAIn-cloud AI has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through this website. However, Internet-based data transmissions may in principle have security gaps, so absolute protection may not be guaranteed; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

Your rights as a data subject

You can exercise the following rights at any time by contacting the person responsible for our data protection:

  • Information about your data stored with us and their processing (Art. 15 GDPR),
  • Correcting incorrect personal data (Art. 16 GDPR),
  • Deletion of your data stored with us (Art. 17 GDPR),
  • Restriction of data processing provided that we are not yet allowed to delete your data due to legal obligations (Art. 18 GDPR),
  • Opposition to the processing of your data by us (Art. 21 GDPR) and
  • Data transferability, provided you have consented to data processing or have concluded a contract with us (Art. 20 GDPR).

If you have given us your consent, you can revoke it at any time with effect for the future.

You may at any time submit a complaint to a supervisory authority if you believe that the processing of personal data concerning you is in violation of the GDPR (Art. 77 GDPR). Recording of general information when visiting our website

The use of our website is possible without an indication of personal data. However, we would like to point out that even in this case access data will be stored in the server log files. These data are in particular the following information:

  • Date and time of the retrieval.
  • Transferred data volume.
  • Message whether the retrieval was successful.
  • Message as to why a retrieval may have failed.

Legal basis: The processing is carried out in accordance with Art. 6 Par. 1 lit. f GDPR on the basis of our justified interest in improving the stability and functionality of our website.

Recipients of the data may be technical service providers who act as contract processors for the operation and maintenance of our website.

The data will be deleted as soon as they are no longer required for the purpose of the collection. For the data used to provide the website, this is generally the case when the respective session has ended.

The Internet pages of the brAIn-cloud AI use cookies. Cookies are text files that are stored in a computer system via an Internet browser.

Web hosting

We use an internet service provider to maintain our online presence, on whose server all information you provide to us is stored (hosting) and which makes our website available on the internet. In doing so, the internet service provider processes contact data, content data, contract data, usage data, inventory data, meta, and communication data on our behalf. The name of the internet service provider is Amazon Web Services. You can view its data protection regulations here: https://aws.amazon.com/service-terms/. The content you enter via our website is exclusively stored on servers located in Frankfurt (Germany). brAIn-cloud AI implemented technical and organizational measures to ensure that all personal data are safe. The internet service provider is based outside the EU. It is certified under the Privacy Shield Agreement and thus offers a guarantee of compliance with European data protection law.

Legal basis: The internet service provider processes the above-mentioned data on our behalf, Art. 28 GDPR. The data processing is based on our legitimate interest in an efficient and secure provision of our Internet offer, Art. 6 Par. 1 lit f GDPR.

Processing of personal data after consent

The purposes of the acquisition and use of personal data shall be as follows. brAIn-cloud AI shall acquire personal information from data subjects to the extent necessary to:

  1. Provide services to the data subject
  2. Bill for compensation for providing the services
  3. Allow data subjects to log in to the services
  4. Provide information on the services’ results, including the idea reports that can be downloaded from the website
  5. Respond to inquiries and contact individuals.

The lawful basis for the processing (as set out in Article 6 of the EU General Data Protection Regulation – GDPR) is as follows: The data subject has given clear consent for brAIn-cloud AI to process their personal data for a specific purpose. The processing is necessary for brAIn-cloud AI’s legitimate interests.

Registration on our website

Type and purpose of processing: When registering to use our personalized services, some personal data is collected, such as name, contact, and communication data (e.g. e-mail address). If you are registered with us, you can access content and services that we only offer to registered users. Registered users also have the option of changing or deleting the data provided during registration at any time if necessary. Of course, we will also provide you with information at any time about the personal data we have stored about you.

Legal basis: The processing of the data entered during registration is based on the consent of the user (Art. 6 Par. 1 lit a GDPR).

Data will only be processed in this context as long as the corresponding consent has been obtained. Afterward they will be deleted, as far as there are no legal obligations to keep them. The user account you get when registering on our website can be deleted at any time. To contact us in this context, please use the contact data given at the top of this data protection declaration. The provision of your personal data is voluntary, solely on the basis of your consent. Without the provision of your personal data we cannot grant you access to our offered contents and services.

Provision of chargeable services

Type and purpose of processing: For the provision of chargeable services, we ask for additional data, such as payment details, in order to be able to execute your order. Only brAIn-cloud AI has access to these payment details.

Legal basis: The processing of the data required for the conclusion of the contract is based on Art. 6 Par. 1 lit b GDPR.

We store this data in our systems until the legal retention periods have expired. These are generally 6 or 10 years for reasons of proper accounting and tax law requirements. The provision of your personal data is voluntary. Without the provision of your personal data we cannot grant you access to our offered contents and services.

Contact form

Type and purpose of processing: The data you enter will be stored for the purpose of individual communication with you. For this purpose, it is necessary to provide a valid e-mail address and your name. This serves to assign the inquiry and to answer it afterward. The specification of further data is optional.

Legal basis: The data entered in the contact form is processed on the basis of a legitimate interest (Art. 6 Par. 1 lit f GDPR).

By providing the contact form we would like to enable you to contact us in an uncomplicated way. The information you provide will be stored for the purpose of processing your inquiry and for possible follow-up questions. There is no transfer of this personal data to third parties. Data will be deleted at the latest 6 months after processing the request. The provision of your personal data is voluntary. However, we can only process your request if you provide us with your name, your e-mail address, and the reason for the request.

Change of our data protection regulations

We reserve the right to adapt this data protection declaration so that it always meets the current legal requirements or to implement changes to our services in the data protection declaration, e.g. when introducing new services. The new data protection declaration will then apply for your next visit.
